Case Dismissed

The defendant was stopped for illegal window tint. After allegedly smelling marijuana the officer ripped the defendant from her vehicle and handcuffed her. The defendant was accused of resisting her arrest. A motion to dismiss was filed arguing that the officer’s actions amounted to an unlawful detention and therefor the defendant was justified in resisting. The state did not contest the motion to dismiss and the charge was dismissed.
