The Client was subject to an undercover investigation by the Polk County Sheriff’s Office where he communicated online via the Whisper app with a detective pretending to be an underage girl. The detective engaged the Client in a conversation where the detective later identified as a 14-year old girl. The Client was contacted multiple times by the detective in an attempt to lure the Client to a location where the two could meet. Although the Client did not agree to meet with the minor, the Client was arrested and charged with one count of Unlawful Use of a Two-Way Communication Device and Transmitting Harmful Material to a Minor. Both charges are felonies and if convicted, the client faced up to five years of prison for each charge and would be required to register as a Sexual Offender for life. Attorney Anthony Rickman diligently worked and prepared a defense showing that the State lacked evidence sufficient to convict the Client. Attorney Anthony Rickman was able to get the State to Nolle Prosse the charge of Transmitting Harmful Material to a Minor and the Client received only probation for the charge of Unlawful Use of a Two-Way Communication Device.
